The Federal Government’s Role in Regulating Online Gambling

One of the most important things to know about online gambling is the difference between “legal” and “illegal.” In many cases, “illegal” Internet gambling refers to illegally betting or transmitting bets. This is in contrast to “legal” gambling, which includes the same things, but is legal. An example of this would be the use of an app to place a bet, although this is not permitted in some states.

Another issue is whether the law regulating online gambling is a federal law or a state law. Several states have legalized online gambling, though most of the action has been in the form of sports betting. The following states allow online sports betting, with more on the way: Alabama, Arkansas, California, Connecticut, Florida, Illinois, Kansas, Mississippi, Missouri, Nevada, New Jersey, North Carolina, Ohio, Oklahoma, Pennsylvania, Texas, Vermont, and Washington.

The most obvious challenge to federal legislation on this topic is the First Amendment. The governing clause of the First Amendment provides limited protection for facilitating speech, and thus, attacks based on this guarantee have been fruitless. In some cases, though, state or local government officials have expressed concern that the Internet could be used to facilitate illegal gambling within their jurisdictions. In response to these concerns, a number of states have enacted or passed laws that are designed to discourage illegal Internet gambling and to enforce their own gambling regulations.

The other issue is the Commerce Clause. Various attempts have been made to prove that Congress has the power to regulate gambling via the Commerce Clause. Using the commercial nature of the gambling industry to its advantage, it is easy to see how the legislature could justify allowing for some of these activities. On the other hand, the fact that a particular action is permitted is not always the most exciting thing.

Some other notable legislative efforts are the Travel Act, which prohibits illegal gambling on interstate commerce; the UIGEA, which bans financial instruments from being accepted by illegal Internet bettors; and the Lopez Amendment, which regulates commercial activity. Each of these acts has its own merits, but the most significant implication is that they reinforce state laws in a manner that may be frustrating to local authorities.
